Stiffer Penalties With Second Or Third DUIs

If you are facing a first-offense DUI, second-offense DUI or third-offense DUI, you must act swiftly to maintain your driving privileges. You have 30 days to request an administrative hearing with the Department of Motor Vehicles (DMV) to prevent losing your driver's license. As the number of drinking and driving offenses goes up, so do the penalties.

The penalties for second-offense DUI with blood alcohol content (BAC) between .08 and .10 are:

  • One-year driver's license suspension
  • $2,100 to $5,100 in fines
  • Minimum of five days to maximum of one year in jail

The penalties for third-offense DUI with BAC between .08 and .10 are:

  • Two-year driver's license suspension
  • $3,800 to $6,300 in fines
  • Minimum of 60 days to maximum of three years in jail

The penalties for fourth-offense DUI with BAC between .08 and .10 are:

  • Permanent driver's license revocation
  • Minimum of one year to maximum of five years in jail
